1. About these terms
Formé by Liv runs Reformer Pilates classes at Sculptd Pilates, 105 Provence Dr, Bournemouth BH11 9FE, and sells digital products and memberships through this website. You can contact us at hello@formebyliv.com.
By booking or buying, you agree to these terms. If you’re buying as a consumer, nothing here affects your legal rights. Some parts apply differently if you’re buying for a business (for example, as an instructor buying class plans for your own teaching business); we point those out where they matter.
2. Prices, orders and payment
- Prices are shown in pounds sterling (GBP) and are the total you pay.
- Payments are taken securely by Stripe. We never see or store your card details.
- Your order is accepted, and our contract with you begins, when your payment is confirmed. We’ll email you a confirmation.
- If a price is shown incorrectly because of an obvious error, we’ll contact you before going ahead, and you can cancel for a full refund.
- Discount codes can’t be exchanged for cash or combined unless stated.
3. Studio classes
- A booking is for one person, for the class, date and time shown. Classes are for ages 16 and over.
- Cancelling: you can cancel from your account up to 12 hours before your class starts. Cancelling in time frees your reformer for someone on the waitlist, and paid bookings cancelled in time are refunded to your original payment method.
- Late cancellations and missed classes: within 12 hours of the start time, bookings can’t be cancelled online and aren’t normally refunded, because it’s usually too late for anyone else to take the space. If something serious comes up, please contact us: we’ll always be fair.
- Waitlists: if a space opens up, the first person on the waitlist is booked in automatically and emailed. That booking is then covered by these terms like any other.
- Arriving late: please arrive 5–10 minutes early. If you arrive after the warm-up we may not be able to let you join safely, and this counts as a missed class.
- If we cancel or change a class: we’ll let you know as soon as we can. You’ll get a full refund, or you can move to another class.
4. Digital products
- Digital products (such as class plans and cue cards) are delivered as downloads, available straight after payment on your downloads page, by email, and in your account library if you have one.
- Please download and keep a copy. We keep your purchases available, but if a product is retired we’ll give you reasonable notice to download it first.
- Download links are personal and expire shortly after use, so please don’t share them.
5. Your licence to use our materials
Everything we sell or release (class plans, cue cards, sequences, videos and their text, design and images) is owned by Formé by Liv and protected by copyright. When you buy, you get a personal, non-transferable licence:
You can
- use the material to plan and teach your own classes, in person or online;
- print copies for your own use, including in the studio;
- adapt sequences and cues for your own clients.
You can’t
- share, forward or upload the files, or give access to anyone else;
- resell, sublicense or include them in anything you sell or give away;
- publish them, or substantial parts of them, as your own work;
- use them to train other instructors or in a teacher-training course.
Studios with several instructors need one purchase per instructor. If you’d like a studio or training licence, get in touch. If these terms are broken, we can end your licence and remove access.
6. Memberships
This covers our monthly memberships, including the FORMÉ Instructor Club and FORMÉ at Home.
- You need an account to join, so your access follows you.
- Billing: depending on the option you choose, memberships are paid monthly, every three months or yearly, in advance, starting on the day you join. They renew automatically at the end of each period until you cancel.
- Cancelling: cancel anytime from your account (“Manage membership”). You won’t be charged again, and you keep access until the end of the period you’ve paid for. We don’t refund part-periods.
- What’s included: while your membership is active you can access its content, including past Instructor Club releases. Access ends when your membership does, so download anything you’d like to keep: the licence in section 5 continues for material you downloaded while a member.
- Failed payments: if a payment fails, Stripe will retry and email you. If it still can’t be collected, your membership may end.
- Reminders: if you’re on yearly billing, we’ll remind you by email before it renews.
- Price changes: we’ll give you at least 30 days’ notice by email before your price changes, so you can cancel first if you prefer.
- Content changes: we may improve or vary what’s released each month, but we won’t materially reduce what a membership offers without telling you, and you can cancel if you’re unhappy.
7. Cancellation rights and refunds
If you’re a consumer, UK law usually gives you 14 days to cancel an online purchase. It works differently for what we sell:
- Digital products and memberships: at checkout you ask for immediate access and acknowledge that you lose the 14-day right to cancel once your download or membership access is available. We record that you agreed. You can still cancel a membership’s future payments anytime (section 6).
- Classes: a class booked for a specific date is a leisure service with a fixed date, so the 14-day right doesn’t apply. Our own cancellation policy in section 3 applies instead.
- If something’s wrong: if a digital product is faulty, not as described, or won’t download, tell us. We’ll fix or replace it, and if we can’t, we’ll refund you. This is on top of your rights under the Consumer Rights Act 2015.
- Refunds go back to your original payment method, usually within 5–10 working days.
8. Health and safety
- Please complete the health questionnaire honestly before your first class, keep it up to date, and tell your instructor before class about any injury, condition or pregnancy.
- Follow your instructor’s guidance, work within your own limits, and stop and tell us if anything feels wrong.
- If you’re unsure whether exercise is right for you, please check with your GP or physiotherapist first.
- Online classes and class plans are general guidance. If you follow them away from the studio, or teach them to others, you’re responsible for checking they suit you or your clients and for teaching them safely.
9. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t legally be limited.
- If we break these terms, we’re responsible for loss you suffer that was a foreseeable result, but not for loss that wasn’t foreseeable.
- If you’re buying as a business: we’re not liable for loss of profit, business or opportunity, and our total liability for any purchase is limited to the price you paid for it.
10. Everything else
- Your data: how we use your information is explained in our Privacy Policy.
- Problems and complaints: please email hello@formebyliv.com. We aim to reply within two working days.
- Changes: we may update these terms. The version on this page when you buy is the one that applies to that purchase; for memberships, we’ll email you about significant changes before they apply.
- Law: these terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring proceedings in your local courts.
